Terms of Service

1. Agreement

These Terms of Service ("Terms") govern access to and use of the Blue Wave Learning assessment platform (the "Service"). By creating an account or using the Service, you agree to these Terms on behalf of yourself and, if applicable, the company you represent.

2. Accounts and access

Access to the Service is by invitation only. A Company Admin is responsible for inviting and managing their own company's staff accounts, and for the accuracy of information provided about their staff. You are responsible for keeping your login credentials confidential.

3. Acceptable use

You agree not to:

• Share your account credentials with anyone else
• Attempt to access another company's data or accounts
• Attempt to bypass, disable, or interfere with assessment timing or scoring
• Use the Service for any unlawful purpose

4. Assessment content and results

Question banks and assessments are created and maintained by Blue Wave Learning. Scorecards are generated automatically based on submitted answers and are provided for the purpose of evaluating staff competency. Blue Wave Learning does not guarantee that any assessment satisfies a particular regulatory, certification, or STCW requirement — it is the responsibility of the company using the Service to determine whether an assessment is fit for their compliance purposes.

5. Company data

A Company Admin may invite, manage, and remove their own company's staff, and may view scorecards for their own staff only. Companies are responsible for having any necessary consent from their staff to use the Service in this way.

6. Availability

We aim to keep the Service available and reliable, but we do not guarantee uninterrupted access. We may suspend or modify the Service for maintenance or other reasons, with notice where reasonably possible.

7. Termination

We may suspend or terminate access to the Service for any account or company found to be in violation of these Terms. A company may request closure of its account at any time by contacting us.

8. Disclaimer and limitation of liability

The Service is provided "as is" without warranties of any kind. To the fullest extent permitted by law, Blue Wave Learning is not liable for indirect, incidental, or consequential damages arising from use of the Service.

9. Changes to these Terms

We may update these Terms from time to time. Continued use of the Service after an update constitutes acceptance of the revised Terms.
